Why Section 232 Articles Are Excluded from the Origin-Based Forced-Labor Layer

Articles and parts already subject to Section 232 tariffs do not also receive this new origin-based forced-labor Section 301 layer.

This is not duty-free treatment. It excludes only the new origin layer; the applicable Section 232 rate, Chapter 99 heading, and other measures still remain.

Conditions to confirm

  • Confirm that the particular article or part is actually subject to Section 232 tariffs.
  • Use the current HTS and Chapter 99 instructions for the entry combination.
  • Preserve evidence about material, specifications, use, and origin.

Limits

  • Being made of steel or aluminum, or belonging to a sensitive industry, does not by itself prove Section 232 coverage.
  • Legacy China Section 301, AD/CVD, and other measures must be evaluated separately.
  • This page does not calculate the product-specific Section 232 rate.
